ACCEPTANCE
All prices offered and orders accepted are subject to the following express terms and conditions and no additions or alterations shall apply unless specifically agreed in writing by Resound Limited (the Seller).
In the absence of written acceptance of these terms, the use of this website to purchase any goods and services by the Buyer shall constitute an acceptance of these terms.
PRICES
All prices on this website are displayed excluding UK Value Added Tax (VAT) unless otherwise indicated.
Whilst we use our best endeavours to display accurate prices for items, we do reserve the right to correct erroneous prices during the order/despatch process. Where the correct price is at variance with the displayed price we will contact the customer prior to despatch to inform them of the discrepancy and allow them to cancel the order (with full credit of monies debited form their credit/debit card) should they want to.
UK VAT will be automatically added (at the prevailing rate) to all transactions that are to be delivered within the UK. For delivery destinations outside of the UK, VAT will temporarily be set to £0.00 within the website's online ordering system, but subsequently our staff will contact the customer to ascertain the correct VAT amount (if applicable). A subsequent charge to the customer's credit/debit card will be applied if necessary.
DELIVERY, RISK AND TITLE
Delivery dates for goods ordered from the Resound Limited website will vary according to availability and/or the need to configure or software programme certain equipment. Any stated delivery date, period or rate is given as a guide only and the Seller accepts no responsibility for loss or damage resulting from delay howsoever arising.
Unless otherwise agreed upon, all shipments are dispatched from the Seller’s facility and packed in accordance with the Seller’s standard practice.
The risk in the goods shall pass to the Buyer at the point of delivery. Delivery and responsibility of the goods will deemed to have taken place once we have a signed delivery advice note or a proof of delivery via our nominated courier. Any short or incorrect shipment must be notified to Resound in writing within 48 hours of receipt of goods
Nothing herein shall give the Buyer the right to return goods to the Seller unless the Seller authorises the return.
For purchased goods, the title to the goods will remain with Resound Limited until cleared funds are received which constitute full payment for the goods. For hired/leased goods, the title to the goods will remain with Resound Limited at all times.
DELIVERY CHARGES
Delivery charges will be levied for both UK and non-UK destinations. These will vary from time to time. The current charging scheme is as follows;
UK Destinations - For orders totalling more than £50.00 (before VAT) delivery will be free of charge. For orders totalling £50.00 or less (before VAT) there will be a single charge of £5.00 per order.
Non-UK Desitnations - Clearly the delivery charge will vary greatly according to the destination as well to the nature of the goods ordered (bulk, insurance requirements, ...). Therefore, after an order has been placed through this website, our staff will contact the customer directly to agree the correct Delivery Charge (and VAT if applicable) prior to despatching any goods. Given that this cannot be done until after the order has been placed, the online ordering system will temporarily set the Delivery Charge (and VAT) to £0.00. A subsequent charge to the customer's credit/debit card will be applied if necessary.
GOODS RETURNS
Should the Buyer wish to return goods bought from the website, they must contact the Seller by telephone or in writing in the first instance. Should the Seller agree to accept the return, then a Job Number will be issued which the Buyer should use to identify the returned goods, suitably packaged. The Seller reserves the right to charge a refurbishment/restocking fee.
WARRANTY
All products supplied are covered by the manufacturer’s warranty, typically 12 or 24 months depending on the manufacturer, unless otherwise stated on the website. The warranty period commences from date of delivery/receipt. The Seller is not liable for any defects arising from fair wear and tear, physical damage, liquid ingression or damage and or interference by the customer or any third party.
The Seller reserves the right to refuse to repair or replace goods under warranty if full payment has not been made or the manufacturer refuses to accept the repairs/replacements under warranty for whatever reason.
TERMS AND PAYMENT
All quoted prices on the website are in Sterling and shall be paid in full to the Seller’s facility in the UK prior to equipment despatch.
DISPUTES
If at any time a dispute or difference arises in connection with the order, it shall be mutually agreed between the Buyer and the Seller or, in the event that agreement cannot be reached, then the dispute shall be settled by an independent arbitrator, to be appointed by the President of Law Society, whose decision shall be binding upon both parties.
CATALOGUES
Catalogues and other advertising materials are only an indication of the type of goods offered and no particulars therein shall be binding on the Seller.
GOVERNING LAW
This contract and all disputes relating to it shall be governed and construed in all respects according to English Law.
